Gentik Subscriber Terms of Service
In force from 18 August 2026. Amended 30 August 2026: Pro's Builds a month was measured at Pro's own depth and corrected in clauses 3.1 and 3.4; it was overstated before. Amended 22 October 2026: Studio's Builds a month is about 65 (was about 100) in clause 3.1 and the summary of the numbers; Studio's price is unchanged.
These terms are the agreement between you and Gentik. They apply when you join Gentik, when you subscribe, and every time you use the service.
We have written them the way we write everything else here. Plain sentences, and the awkward parts said out loud rather than buried. Where a term is against your interest, we say so in the clause rather than in a footnote.
The three things people most often want to know, so you do not have to hunt for them:
- An agent can be wrong, and it will sound exactly as certain as when it is right. Checking the facts in it before you act on it is your job, and clause 10.7 says exactly which facts and to what standard.
- We do not refund a month you have started. Clause 7 sets out what that does and does not mean, including the rights you keep whatever this document says.
- Your Builds are yours. We host them for three days after your subscription ends, and an exported file has no expiry. Clause 8 gives the exact dates and the one thing that catches people out.
1. Who we are, and who these terms are for
1.1 Gentik is operated by Gentik Ltd, a company registered in England and Wales. Our registered address and company number are on the website. "Gentik", "we" and "us" mean that company. "You" means the person who holds the account.
1.2 These terms cover subscribers: people who rent a bench, equip agents on it, and commission Builds.
1.3 Different terms cover different people. A creator who claims an agent named after them signs a separate claim agreement. A maker who lists an agent on the marketplace agrees separate maker terms. If you do both, both apply, each to what it covers.
1.4 You must be at least 18 to hold a subscription.
2. What you are buying
2.1 You are renting a bench. A bench is a workstation for agents. Your plan buys the bench, the number of places on it, the number of projects you can run, and a monthly allowance of work.
2.2 You are not buying an agent, and you are not buying "an AI". Agents are equipped onto your bench and removed from it. Nothing here is bought once and owned forever, on either side.
2.3 A plan gives you all of the following.
| What the plan gives you | What it means |
|---|---|
| Places on your bench | How many agents you can have equipped at one time |
| Projects | How many separate pieces of work you can keep notes and history against |
| One included agent | One Gentik agent, working at standard size or lighter, at no additional charge |
| A monthly allowance of Builds | Measured in load, described in clause 5 |
2.4 One agent is included. Every other agent bills at its own monthly price, whether Gentik made it or somebody on the marketplace did. Your included agent must be a Gentik agent that works at standard size or lighter. Agents that build heavy work are not available as the included one.
2.5 So a bench with four agents on Starter costs £6 plus three agent prices, not £6. Your bill is itemised in your account, always, and shows every line.
2.6 A Build is a finished piece of work an agent hands you: a teardown, a plan, a rewrite, a working prototype. It is a document. A conversation is how you get to a Build. It is not the Build.
2.7 A Gentik agent needs your material. An agent does not produce a Build out of nothing. You supply the work you want looked at, and the agent hands back a document about it.
3. Plans and prices
3.1 The plans, and the prices, are these.
| Plan | Price | Places | Projects | Builds a month | Card |
|---|---|---|---|---|---|
| Free | £0 | 1 | 1 | 1 Build, ever | Required, never charged |
| Starter | £6 a month | 3 | 3 | about 20 | Required |
| Studio | £18 a month | 10 | 10 | about 65 | Required |
| Pro | £39 a month | 25 | 25 | about 55 | Required |
3.2 All prices include VAT where VAT applies.
3.3 "About 20" is not a fixed count, and we say "about" because a Build is not one size. A one line rewrite is small. A teardown of ninety days of data is not. Each Build uses what it actually needs, so a light month gets you more than the number and a heavy one gets you fewer. Clause 5 explains how this is measured.
3.4 Pro is not sold as unlimited, and never will be. Every unlimited plan carries a ceiling somewhere, and the day you find it is the day the word turns out to have been marketing. What Pro buys at the top is our deepest work on every Build: longer reasoning, and more of the problem held at once. It is not a bigger number with the same thinking behind it. Measured at that depth, a month of Pro is about 55 Builds of the usual size, or about 25 of the deepest kind. The number is smaller than a lighter plan's because each Build carries more, and we would rather tell you that here than have you find it out.
3.5 We do not claim that a higher plan produces better results, because we have not measured that. What we tell you is what the plan actually gives you, and you decide whether it is worth the money.
3.6 An agent's price is the same whoever made it. We do not give our own agents away to undercut people selling on our marketplace.
4. The free plan
4.1 The free plan gives you one Build, ever. Not one a month. One in total, so you can see what a Build actually is before you decide anything.
4.2 The free plan gives you one place on your bench, one project, and one included Gentik agent working at standard size or lighter. You may swap which agent that is. There is nowhere to add a second, so the free plan is the whole bill.
4.3 Heavy Builds are what a subscription buys. The free agent does not make them.
4.4 We ask for a card on the free plan, and we do not charge it. We are telling you this here because a free tier that asks for a card is one of the most distrusted patterns on the internet, and burying it would make it worse.
4.5 The reason we ask is simple. The free Build is one per person, ever. An email address costs nothing to invent, so an email address cannot tell us whether you are one person or forty. A card can. That is the whole reason it is there.
4.6 So that the promise is precise:
- Nothing is charged when you join, and nothing is charged when your free Build is used up.
- This is not a trial that becomes a subscription. If you want a paid plan later, you choose it deliberately.
- You may remove the card at any time from your account. Your Builds stay yours.
- Your card details go to Stripe and never touch Gentik. We are told whether the card is valid and nothing else.
4.7 One free Build is one per person. Opening additional accounts to take additional free Builds is a breach of clause 12, whether you do it with new email addresses, new cards, or both.
5. Load, allowances and refills
5.1 Load is how much of your month a Build uses. Big Builds use more than small ones. Your workspace shows how much of the month you have used, while you are working and can act on it.
5.2 Builds come in three sizes: light, then standard, then heavy.
- Light is a short piece: a verdict, a review of one thing, a call.
- Standard is the usual size: a teardown, a plan, a rewrite with the reasoning.
- Heavy is a large piece: a working artefact you can click through, or a plan across many weeks.
5.3 Heavy does not mean harder for you. It describes what you get back, not what you put in.
5.4 You see the size of a piece of work before you commission it, never after. An agent tells you when a job is unusually large before it starts. Nothing big happens to your month without you seeing it coming, and if we fail to show you a size before you commission, the load for that Build is not charged against your month. Tell us within 30 days and we put the load back, and if the month has already reset we add it to the current one.
5.5 "Up to heavy" on an agent is its ceiling, not its usual size. An agent marked up to standard will not build heavy work, whatever you ask it for.
5.5a A maker can change that ceiling, and you are told when it drops. If a maker lowers the size an agent you have equipped will build, we tell you on the agent itself: what it no longer builds, when it changed, and that everything it has already made for you is still yours. We would rather tell you than let a piece of work you used last week quietly vanish from the menu.
5.5b A ceiling never rises without the notice a price rise gets. If a maker raises the size, and that means a higher price, the new size and the new price reach you on the same day, after the 30 days in clause 6.6. Nothing about your agent gets bigger and dearer without you having had a month to decide whether to keep it.
5.6 When the month is used up, everything you have already made stays exactly where it is: readable, editable and exportable. Your agents stay on your bench. What you cannot do is start a new Build until the month resets or you refill it.
5.7 We never automatically charge you for going over. Adding more is a decision you make. It is not something that happens to you while you are not looking.
5.8 Waiting is a real option and costs nothing. Your month resets on the same date each month. If you are not mid job, waiting is what we would do, and we say so on the screen where you run out rather than only in this document.
5.9 A refill tops up the current month and nothing else. It does not roll into the next month. There is no balance to build, nothing that expires unspent, and buying two at once does not make either cheaper. We deliberately did not build a currency.
5.10 If you find yourself refilling most months, the next plan up is cheaper than the refills. We tell you that at the moment you run out.
5.11 A refusal is not a Build. If an agent declines a commission because the subject is outside what it holds, that does not use your load.
6. Billing, renewal, price changes and cancellation
Billing
6.1 Payments are taken by Stripe. Your card details go to Stripe and are never held by Gentik. We are told whether a card works and nothing more.
6.2 Your subscription is charged on the same date each month, in advance, until you cancel. Your bench charge and every equipped agent's charge appear as separate itemised lines.
6.3 If a payment fails we will tell you and try again. If it has not succeeded after 7 days we may suspend the bench. Suspension is not termination: your Builds and projects are untouched, and paying restores everything.
Renewal and price changes
6.4 Your subscription renews monthly until you cancel it.
6.5 We may change the price of a plan. If we do, we will tell you by email at least 30 days before the new price applies to you, and the new price takes effect at your next renewal after that notice period. You may cancel at any point before it takes effect and the change will never apply to a month you have already paid for.
6.6 An agent's own monthly price is set by whoever made it. If a maker raises the price of an agent you have equipped, we will tell you at least 30 days before the new price is charged to you. If you do nothing, the agent stays on your bench at the new price. If you remove it before then, you are never charged the increase.
Cancelling
6.7 You can cancel at any time, from your account, in one click. There is nothing to phone and nobody to persuade.
6.8 When you cancel:
- Your subscription runs to the end of the period you have already paid for.
- Your agents leave the bench at the end of that period.
- The current period is not refunded. See clause 7.
- Your Builds and projects stay readable on Gentik for three days after the subscription ends. Clause 8 sets out exactly what that means and what to do about it.
6.9 Removing a single agent from your bench stops its charge at the end of the period you have paid for. It does not reach back and take away the work that agent made.
7. Refunds, and the rights you keep whatever this document says
7.1 We do not refund a month you have started, for a change of mind, for a period you did not use, or because the work an agent produced was not what you hoped.
7.2 That sentence has four exceptions and we list them here rather than letting you find them. Your first 14 days, on every line of the bill (clauses 7.5 and 7.5a). A fault on our side (clause 7.12). A change that makes the service materially worse (clause 16.5). A long outage outside our control (clause 18.6). There is also clause 7.13, where we may refund because we think we should.
The 14 day cancellation right
7.3 When you subscribe you ask us to begin supplying immediately. You do that expressly at checkout, before we take any money, and we send you written confirmation of it on a durable medium. Two different things follow, and they are not the same thing, so we set them out separately.
7.4 Digital content: the 14 day right ends once we start. A Build, and any other digital content we supply straight away, falls under regulation 37 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. When you ask us to supply it immediately and acknowledge that you lose the right to cancel it, that right is gone for that content.
7.5 The subscription itself: you keep the 14 days, and you pay for what you used. A bench is a service, and asking us to start does not take your cancellation right away. If you cancel a new subscription within 14 days of taking it out, you get back the part you did not use. The law says we may keep what we have actually supplied, and your bill has two kinds of line, so we work each out the way that line is earned.
7.5a Both kinds of line are refunded, and here is how each is worked out. Your bill is a bench charge plus a charge for each agent you have equipped (clause 6.2), and the agent charges are usually the larger part of it. Both are in.
- Your bench charge is refunded by the load you did not use. Load is what that charge buys (clause 5.1), and your workspace shows you the figure as you go. If you have used a fifth of your month, you get back four fifths of the bench charge.
- Each agent charge is refunded by the days you did not have it. An agent's price buys you the agent on your bench for the month, so time is the right measure for it.
7.5aa We use load rather than days on the bench charge because days would be the wrong answer in both directions. Someone who commissions a month of work in three days has had the month, and someone who commissions nothing for a fortnight has had none of it. A worked example, so the sums are not a surprise: on Studio at £18 with one £14 agent equipped, cancelling on day 13 of a 30 day month having used four fifths of your load, you get back roughly £3.60 of the bench charge and roughly £8.93 of the agent charge.
7.5b Your refund comes from us, and nothing about it depends on a maker. A creator or maker receives 70% of their agent's price (clause 11.8). That is our arrangement with them and it never reduces what you get back. You are refunded the part of the month you did not use, on the whole bill, and you never have to ask a maker for anything or wait on one.
7.5c If a load claim succeeds after you have already been refunded, we pay you the money. Clause 5.4 gives you 30 days to tell us a Build was charged without its size being shown, and that is longer than the 14 days in this clause. Normally we put the load back into your month. If you have cancelled, there is no month to put it back into, so we pay you what that load was worth instead. Your refund is not reopened and nothing is recalculated. You do not lose a claim because you left.
7.6 So clause 7.1 governs everything after your first 14 days, and every renewal after the first. It is not a claim that you have no statutory cancellation right, because you do.
What the law gives you regardless
7.7 We would rather write this down than let you find it out from somebody else. Under the Consumer Rights Act 2015 we must supply this service with reasonable care and skill, and the digital content you receive must be of satisfactory quality, fit for purpose, and as described. Where we fall short of that, you are entitled to a repair or a replacement, and to a price reduction where neither is possible. You cannot sign those rights away and this document does not try to make you.
7.8 What "broken" means here, so that both of us are working from the same line:
If it is broken: an agent that will not load, will not answer, or is not the subject it was sold as. Not one you disagree with. Report it and we will put it right or move you off it. Your Builds stay yours either way.
7.9 "Not one you disagree with" is the load-bearing part of that sentence and it is deliberate. An agent that states something wrong, confidently, is not broken. Clause 10 explains why we treat that as a known property of the thing you bought rather than a fault, and it is the counterpart to your obligation to check.
7.10 Clause 7.8 is a description, not a boundary on clause 7.7. It names the three faults we see most and it does not shorten the standard the law sets. An agent that answers fluently and on subject, and is nonetheless wrong so consistently that it is not of satisfactory quality or not as described, is covered by clause 7.7 even though it is not in the list. One wrong answer is clause 10. A pattern that means the agent does not do what it was sold as doing is a fault, and we will treat it as one.
Reporting and remedies
7.11 How to report something. Tell us from the agent's page, or write to the support address on the website. Every report is read by a person, and the queue is worked oldest first. We check the claim rather than counting reports: fifty accounts sending the same claim means an operator reads one claim. You hear the outcome either way, including when we decide the agent stays.
7.12 If we agree an agent is faulty under clause 7.7 or clause 7.8, we will repair it or move you onto a comparable agent at no additional cost, within a reasonable time and without significant inconvenience to you. If neither is possible, you are entitled to an appropriate reduction in price, which may be the whole of what you paid for it.
7.13 We may also refund at our discretion where we think it is the right thing to do. Doing so once does not oblige us to do it again, and it is not an admission that anything was broken.
7.14 If Builds genuinely stop working because of a fault on our side, that is a service failure rather than a disappointing answer. We will say so, stop charging for the affected period, and credit it. We will not describe an outage as a feature.
8. Your Builds
8.1 The Builds an agent makes for you are yours. We claim no ownership of them, and no licence to use them beyond hosting them for you and doing what you have asked us to do with them.
8.2 The work is yours. The worker is not. Removing an agent from your bench does not reach back and take away what it made. Every Build it made stays in your library, and removing an agent never shortens the hosting of anything it built.
8.2.1 How long we host is a separate question from who owns it, and the answer is in clause 8.4. While you hold a subscription, your Builds stay hosted. When a subscription ends, hosting runs for three more days. On the free plan, your Build stays hosted while the account is open. Ownership does not expire at any point, and clause 8.3 is the part that lasts.
8.3 Exported Builds are yours with no expiry. An exported Build is a file on your machine with nothing of ours in it, no expiry, and nothing we do later can reach it. You can export any Build, or all of them at once, at any time.
8.4 What ends when your subscription ends is our hosting, not your ownership.
| Exported files, once you have them | No expiry |
|---|---|
| Builds hosted on Gentik after your subscription ends | 3 days |
| Your projects and notes after your subscription ends | 3 days |
| If you resubscribe within those 3 days | Nothing is lost |
8.5 That three day figure is a promise with a deadline and we will keep it exactly. Your Builds stay readable on Gentik for three full days after your subscription ends, so you are not caught out, and then they come off our servers. We will not shorten that period for an existing subscriber. We put the export button in front of you at cancellation rather than waiting to be asked.
8.6 The thing that catches people out. Any Build you have shared by link stops working when those three days are up. If you sent one to a client or a colleague, that link goes dead and they see nothing. Exporting saves the document, not the URL, so send them the file instead, or tell them before it happens. Your cancellation screen tells you how many of your Builds are currently shared.
Sharing
8.7 Every Build is private until you share it. You choose. A shared link is public to anyone holding it: no sign in, no account, and anyone they forward it to can read it too. Share a Build the way you would send a document, because that is what it is.
8.8 You can make a shared Build private again at any time, and the old link stops working immediately.
8.9 Your project notes are never on a shared Build. A reader sees that notes were used and how many, and not one word of what they say. This is a technical guarantee and not a courtesy. A reader of a shared link does see the Build itself, the material you submitted for it, and which agent made it, so do not share a Build containing material you would not want that reader to have.
8.10 You are responsible for what you choose to share and with whom.
Deleting
8.11 Deleting a Build deletes the Build and the material it was made from. Notes are listed separately and you delete them separately, so nothing you meant to keep disappears without you deciding.
9. Projects, notes and what we do with your material
9.1 Three things are absolute, and they are the whole reason anyone hands over work they have not published.
- Nothing you submit is added to what any agent knows.
- Nothing you submit reaches another subscriber, ever.
- Nothing you submit changes the agent, which is identical for everyone.
9.2 We do not distil our subscribers. What you give an agent never becomes part of what that agent is. An agent reads what you gave it, makes your Build, and what it learned about you stays in your project and nowhere else.
9.3 Ten people can use the same agent and none of their work meets. Each Build sees exactly one subscriber's material. There is no shared memory between subscribers and no route by which one subscriber's brief could reach another.
Project memory
9.4 You may keep notes on a project, and your agents read them before every Build. That is what stops you explaining the same thing twice. Notes live in your account, beside the agent rather than inside it, and are loaded only into your own work.
9.5 Notes are yours. You can read, edit and delete any of them at any time.
9.6 An agent may propose a note, drawn from work you have just done together.
9.7 A proposed note does nothing until you accept it. It is visibly not in effect until then, and you choose Accept or Dismiss. Nothing an agent proposes shapes any future Build unless you have said yes to it.
9.8 We do this because an agent's note is a claim, not a fact. It can be wrong in exactly the confident voice clause 10 describes, and a wrong note is worse than a wrong answer: a wrong answer is visible once, a wrong note is invisible and shapes everything after it. Accepting is the moment a person checks it.
9.9 Every note says where it came from. "You wrote this" and "Your agent noted this" are recorded separately and stay distinguishable. If you correct a note your agent proposed, the record says your agent noted it and you corrected it. Editing does not launder an agent's claim into your own words.
9.10 You decide what a note may contain. An agent cannot tell a convention from a confidence. A note about how you like to work belongs in the notes and will be used. A client's name, an unreleased campaign, or anything you would not want appearing in a document you might later share is yours to keep out, and clause 8.9 is what limits the damage if you do not.
What happens to notes
9.11 Notes are severed from the Build they came from and have their own lifecycle. Deleting a Build does not delete a note taken from it, and deleting a note does not delete the Build. That means deletion is two steps, and we would rather name that cost than have your memory develop silent holes.
9.12 If an agent you hold notes against is withdrawn by its creator or removed from the marketplace, your notes are not destroyed and are not moved onto a different agent without you. They stay in your project, and you decide where they go next.
9.13 Notes are hosted for three days after your subscription ends, on the same footing as Builds under clause 8.4, and can be exported before then.
10. An agent can be wrong, and checking it is your job
10.1 This clause has two halves. What you are accepting about the product, and what you are undertaking to do. Both are terms and neither works without the other.
What you are accepting
10.2 An agent can be wrong, and it will sound exactly as certain as when it is right. It writes in one confident voice whatever it is doing, and it has no way to tell you which parts it is sure of. The mistakes that catch people out are the ones that do not look like mistakes.
10.3 This is a known property of what you are buying, not a defect. You accept it when you subscribe. An answer that is wrong, or that you disagree with, or that turns out to be unhelpful, does not entitle you to a refund and is not "broken" within clause 7.8.
10.4 Where to be careful: names, figures, dates and quotes. An agent will give you those in the same tone as everything else. What an agent is genuinely for is the thinking: the questions worth asking, the approach, the thing you had not considered.
10.5 This is true of every agent on Gentik without exception. A verified creator's agent with two hundred subscribers can be wrong exactly as readily as one listed yesterday. We say it on every agent, of every kind, so that nobody reads a badge as a promise of accuracy.
Your obligation
10.6 You must check an agent's output before you act on it. Check it the way you would check a capable colleague's first draft.
10.7 What that means in practice, so it is a standard and not a feeling. Before you rely on a Build, verify against a source outside Gentik any name, figure, date, quotation, citation, legal or regulatory statement, or factual claim about a third party that you are going to act on or pass to somebody else. Those are the things an agent gets wrong while sounding certain, and they are the things clause 15.5 allocates to you.
10.8 You are not obliged to check the judgement. An agent's reasoning, its approach, its opinion about your work: those are what you bought, you are free to take them or leave them, and disagreeing with one is not a failure to check. The obligation reaches checkable facts, and stops there.
10.9 You are responsible for what you do with a Build. You decide whether to publish it, send it to a client, act on it, or rely on it. That decision is yours and we do not make it with you.
10.10 Do not use a Build as advice you are entitled to rely on without checking. Gentik does not give legal, financial, medical, tax, safety or professional advice, and no agent on Gentik does either, whatever subject it was distilled from. If a decision needs a qualified professional, it still needs one after you have read the Build.
10.11 If you are acting for a client or an employer, you are responsible for telling them what you used and for checking it to the standard your own work requires.
What we do not do
10.12 We do not read your Builds to check them, and no creator does either. An agent writes a new answer every time somebody asks. Nobody has read yours before you, including us.
10.13 We do not warrant that any agent's output is accurate, complete, current, or fit for a purpose you have in mind. We do warrant, because the law requires it and because it is right, that we will supply the service with reasonable care and skill, and clause 7 is what you get if we fall short of that.
10.14 This clause is not a general escape and is not written as one. It allocates one specific risk: the accuracy of an individual answer or Build. It does not touch our obligation to provide a working service, it does not touch clause 7.7 or clause 7.10, and nothing in it limits liability that clause 15.2 says cannot be limited.
11. Agents named after real people, and agents made by other people
The separation
11.1 Some agents on Gentik carry a real person's name, with their consent, and are built from work that person taught in public.
11.2 An agent built from a person is not that person.
11.3 They do not see what it says. It writes a new answer every time somebody asks, so nobody has read that answer before you, including them. If it says something wrong, that is the agent being wrong and not a view that person holds.
11.4 Do not quote an agent as something that person said. Nothing an agent produces is a statement by, an endorsement from, or advice given by the person it is named after. Repeating it as their view is a misuse of the product and a wrong done to them.
11.5 What a creator's name does mean is real and is what you paid for: they built the agent from their own teaching, they chose what it holds and what it refuses, and they take 70% of what you pay. It is bounded by their work. What it is not is them sitting behind it checking answers as they go out.
11.6 A community agent carries the name of whoever assembled it. That person has not verified a channel and the agent is not built from their own teaching. Their name tells you who put it together and nothing more.
Who you contract with
11.7 Your contract is with Gentik, for every agent on your bench, whoever made it. You pay us, we bill you, and clause 7 is your route if something is broken. You do not enter a contract with a creator or a maker by equipping their agent, and they owe you nothing directly.
11.8 A creator or maker sets the price of their agent and receives 70% of it. That split is between them and us. It does not change what you pay, it does not change who is answerable to you, and it never reduces a refund you are owed under clause 7.5.
11.9 Every agent is separately priced and nothing is pooled. Adding an agent to your bench never changes what another creator is paid.
If an agent goes away
11.10 A creator may withdraw their agent, and we may remove an agent from sale.
11.11 If an agent you have equipped is withdrawn or delisted, you keep access to it until the end of the period you have already paid for. After that it comes off your bench and you are not charged again for it.
11.12 Every Build that agent made stays in your library, on the same terms as clause 8. Withdrawal never reaches back into your work.
11.13 If we remove an agent because it was faulty within clause 7.7 or clause 7.8, we will move you onto a comparable agent where one exists, at no additional cost.
11.14 We may withdraw any agent at any time. We do not guarantee that a particular agent will remain available, and a bench place is not a reservation of a specific agent.
If you make agents yourself
11.14a A channel becomes unavailable once its creator claims their own agent. Anyone may build an agent from public teaching. But when the person behind a channel claims their own agent on Gentik, their channel stops being available for anyone else to add to a new agent, for as long as they hold that claim. When you try to add one, we tell you plainly that this has happened.
11.14b Anything you already built keeps what it had. If you added a channel before its creator claimed, it stays in your agent, whether you had published it or were still building. We do not reach back into work you have already done.
11.14c You are never left short. If an agent of yours ever needs a replacement source, you may add any channel that has not been claimed. This never leaves an agent below what it needs to stay published.
11.14d It is not permanent and it is not about the subject. A channel returns to the pool if its creator stops holding the claim. And it is one channel, not a topic: other people teach the same subjects, and you may still build about them.
Unlisted agents
11.15 Some agents are not on the marketplace shelf. They can be found by name, on their maker's profile, or by a link. Not being on the shelf does not mean an agent is bad. It means it has not yet been kept by enough subscribers to have earned a place, and every agent starts there.
11.16 Equipping an unlisted agent is a real allocation of risk and we do not treat the click as a formality. Before you can equip one you must read and accept a notice that says, in these terms:
- Nobody has bought it yet, so we cannot tell you how it went for them.
- It can be wrong, and it will sound just as certain as when it is right.
- It might simply not be very good. The subscription starts straight away and is not refunded for a change of mind, so if it disappoints you, you can remove it and stop paying from next month, and this month stays spent.
- If it is broken within clause 7.8, the remedy in that clause applies to it exactly as it does to anything else.
11.17 By accepting that notice you confirm that you understand there is no track record for that agent, that the month is not refundable if it disappoints you, and that you want it anyway. You are choosing that agent rather than being shown it, and that is what makes the acceptance meaningful.
11.18 Clause 7.7, clause 7.8 and clause 7.10 apply to unlisted agents in full. Accepting the notice does not waive them and cannot.
12. Acceptable use
12.1 One Build at a time per account. This is a technical limit and it is deliberate: it costs a person nothing and it makes automated farming pointless.
12.2 One card, one subscription, one person. Do not open multiple accounts to take multiple free Builds, to work around a plan limit, or to evade a suspension.
12.3 You must not:
- use automated tools, scripts or bots to commission Builds or to create accounts;
- share your account or your sign in link with anyone else, or sell access to your bench;
- attempt to extract, reconstruct, or reproduce an agent's underlying makeup, its instructions, or the material it was distilled from, whether by prompting, by scraping, or by any other route;
- attempt to make an agent output verbatim passages of any creator's source material;
- use Gentik to produce material that is unlawful, defamatory, harassing, or that infringes anyone's rights;
- submit material you do not have the right to submit;
- submit other people's personal data without a lawful basis for doing so;
- present a Build as a statement by, or as advice from, any real person, including a creator whose agent produced it;
- interfere with the service, probe it for vulnerabilities, or attempt to circumvent any limit or control;
- resell, sublicense or redistribute access to an agent.
12.4 You keep your material and your Builds. You give us only the licence we need to run the service for you: to store your material, pass it to the agent you commissioned, produce your Build, host it, and serve it at a link if you have chosen to share one. That licence ends when the material does.
12.5 You confirm you have the right to submit what you submit, and that submitting it to us and having a Build made from it does not breach anyone else's rights or any obligation of confidence you are under.
13. Suspension and termination
13.1 You may close your account at any time.
13.2 We may suspend or terminate your account if you breach clause 12, if payment fails and stays unresolved under clause 6.3, or if we are required to by law.
13.3 Before we suspend or terminate for a breach we will tell you what the breach is and give you a reasonable chance to put it right, unless the breach is serious enough that we cannot, or unless doing so would be unlawful.
13.4 What happens to your Builds if we terminate your account.
- If you cancel, or if we terminate for any reason other than a serious breach: clause 8.4 applies in full. You have three days of hosting and you can export everything, including all at once. We will tell you before the three days start.
- If we terminate for a serious breach, your access to the service ends immediately, and we will still give you three days to export your Builds and notes before removing them, unless a court or the law prevents it, or unless the export itself would cause the harm we terminated you for. We do not use deletion of your work as a penalty. Your access continues in an export only form for those three days, so there is always something to export with.
13.5 Termination does not refund a period you have paid for, and it does not release you from a charge already due.
13.6 If we close the service entirely we will give you at least 60 days notice, stop taking payments, and keep your Builds available for export throughout that period.
14. Your data
14.1 We are the data controller for personal data we hold about you. Our privacy notice on the website gives the full detail and this clause gives the shape of it.
What we hold
14.2 We do not store your email address. We turn it into a scrambled string and store that instead. It is enough to know you are you when you come back, and it is not enough to write to you, sell to you, or hand to anyone. You will get sign in links and receipts. Nothing else.
14.3 We do not hold your card details. Stripe takes them and holds them. We are told whether a card is valid, and nothing more.
14.4 We hold: your account and plan, your bench, your projects and notes, the material you submit, the Builds made from it, your load usage, your billing records, and ordinary technical and security logs.
What we never do with it
14.5 The three absolutes in clause 9.1 are data protection commitments as well as product ones, and they bind us. Your material is never added to what any agent knows. It never reaches another subscriber. It never changes the agent.
14.6 We do not use your material to train, build, improve or extend any agent, ours or anyone else's. We foreclose that deliberately, because a person will not hand an agent their unreleased work if there is any chance it becomes somebody else's answer.
14.7 We do not sell your data, and we do not share it for anybody's advertising.
14.8 We use processors to run the service, including for payment. Where a processor holds your data they do so under a contract that binds them to these limits.
Your rights
14.9 You can ask us for a copy of the personal data we hold about you, ask us to correct it, ask us to delete it, ask us to restrict what we do with it, and object to processing. Write to the address in our privacy notice. We answer within one month.
14.10 Deletion is real. Asking us to delete your account deletes your projects, your notes, your submitted material and your hosted Builds. Export first, because clause 8.3 is the part that lasts. We keep billing records for as long as tax law requires and nothing beyond that.
14.11 You can complain to the Information Commissioner's Office. Complaining to us first is welcome and is not a requirement.
15. Our liability to you
15.1 This clause sets out what we are and are not responsible for. It is written to be precise rather than wide, and it does not attempt to excuse everything. A term that guts the substance of what you bought would not be worth having and would not be enforceable.
What we never exclude
15.2 Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot lawfully be limited or excluded, including your rights under the Consumer Rights Act 2015 as described in clause 7.7;
- defective products under the Consumer Protection Act 1987.
What we are responsible for
15.3 We are responsible for supplying the service with reasonable care and skill, and for loss you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill.
15.4 If we fail to supply the service, clause 7 sets out what you get, and clause 7.14 sets out what happens if a fault on our side stops Builds working.
What we are not responsible for
15.5 We are not responsible for the accuracy of an individual answer or Build, which clause 10 explains is a known property of the product rather than a defect. So we are not liable for loss caused by an agent stating something incorrect or out of date in work you then acted on, where the statement was one clause 10.7 required you to check and you did not check it.
15.6 The limits of clause 15.5, because a clause that excused everything would be worth nothing. Clause 15.5 does not apply where:
- the agent was faulty under clause 7.7 or clause 7.8, including the pattern case in clause 7.10;
- we failed to supply the service with reasonable care and skill;
- the loss is one clause 15.2 says we never exclude.
15.7 Clause 15.5 covers accuracy. It does not cover an agent failing to do the job it was sold as doing. An agent that omits the thing you commissioned it to find has not made an inaccurate statement, it has failed to perform, and clause 7 governs that rather than this clause.
15.8 We are not responsible for a decision you made using a Build, for how you used a Build, for who you shared it with, or for what somebody else did with a Build you shared.
15.9 We are not responsible for loss caused by material you submitted that you did not have the right to submit.
15.10 We are not liable for a loss neither of us could have seen coming. If a Build was going into something unusually valuable and the loss would not be obvious from the outside, tell us before you commission it. We cannot take account of a risk we were never told about.
15.11 We do not limit liability for a foreseeable loss simply by calling it indirect. Where a loss genuinely follows from our breach, clause 15.12 is the limit that applies to it and no other exclusion overrides it.
The cap
15.12 Where liability is not covered by clause 15.2, our total liability to you for all claims arising in any twelve month period is limited to the greater of:
- the total amount you paid us in the twelve months before the claim arose, or
- £100.
15.13 The £100 floor is there so the cap is never zero for somebody on the free plan or in their first month.
15.14 Plenty of people here are sole traders or freelancers using this for client work, and clause 10.11 assumes exactly that. You are still a consumer in law if you are buying mainly outside your trade, and nothing in these terms tries to argue you out of that.
15.15 Where you are genuinely buying for a business, we are not liable to you for loss of profit, loss of business, loss of contracts, loss of goodwill, or business interruption. Clause 15.12 still applies to everything else. If you are a consumer, this clause does not touch you and clause 15.2 is unaffected either way.
16. Changes to the service and to these terms
16.1 We improve the service, and that means it changes. We add agents, retire agents, and change how things work.
16.2 We may change these terms. If the change is material and affects you, we will tell you by email at least 30 days before it takes effect. If you do not accept it, cancel before it takes effect. The current version is always on the website with the date it came into force.
16.3 Two things we will not change to your disadvantage while you are a subscriber: the three day hosting period in clause 8.4, and the three absolutes in clause 9.1. If either ever changes, it changes for new subscribers and after notice, never retrospectively and never quietly.
16.4 A price change is governed by clause 6.5, not by this clause.
16.5 If we change the service so that it is materially worse than what you subscribed for, you may cancel and we will refund the unused part of the period you have paid for. That is a specific right and it does not conflict with clause 7.1, which is about a month you started on the service as it was sold.
17. If something goes wrong between us
17.1 Talk to us first. Most things are fixed the same week. The support address is on the website, and every report is read by a person.
17.2 If we cannot resolve it, you can take the matter further and these terms do not stand in your way.
17.3 These terms and any dispute arising from them are governed by the law of England and Wales. You and we both agree that the courts of England and Wales have jurisdiction, and if you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
17.4 Nothing in these terms affects your statutory rights as a consumer.
18. General
18.1 If a clause turns out to be unenforceable, the rest still stands. A court striking out one part does not take the rest with it.
18.2 We do not lose a right by not enforcing it straight away. If we let something go once, that is us being reasonable about one occasion. It is not us agreeing it can happen every time.
18.3 You may not transfer your account to anyone else. We may transfer this contract to another company if our business is sold, and if we do we will tell you and you may cancel.
18.4 Nobody other than you and us has rights under this contract. A creator or maker whose agent you have equipped is not a party to it.
18.5 These terms, your plan, and anything you accepted at checkout are the whole agreement between us about your subscription. What that does not do is let us walk away from something we told you. If a page on our website or a message from us said something specific about what you were buying, and you relied on it, you can hold us to it. This clause is here to stop a stray sentence contradicting a term, not to make our own claims unenforceable.
18.6 Some things stop us working and are nobody's doing. A power or network failure at a scale we cannot route around, a strike, a flood, a fire, war, or a change in the law that makes part of the service unlawful. While one of those is stopping us, we are not liable for failing to do the thing it stopped.
18.7 We stop charging you while it lasts, from the day we know, and we credit any part of a period you paid for and did not get. Clause 7.14 says the same thing about our own faults, and we are not going to treat you worse because the cause was outside our control. If it lasts more than 30 days you may cancel and we will refund the unused part of the period you have paid for.
